The U.S. Department of Justice (DOJ) announced a lawsuit against Alabama on Friday, challenging the state’s effort to remove noncitizens from its voter rolls just ahead of the November presidential election.
According to the DOJ, Alabama’s actions may violate federal law, particularly as they come within 90 days of the election.
This timing could affect voter access, which is protected under the National Voter Registration Act (NVRA).
The NVRA prohibits purging voter lists within 90 days of an election to prevent improper disenfranchisement.

Assistant Attorney General Kristen Clarke stated that the DOJ is asking the court to restore the names of voters Alabama deemed ineligible.
The DOJ’s lawsuit also raises concerns that some eligible citizens may have been mistakenly flagged as noncitizens and moved to an inactive voter list, which could prevent them from voting.
Alabama Secretary of State Wes Allen defended the state’s actions, explaining that they used U.S. Department of Homeland Security data to identify 3,251 potential noncitizens on the voter rolls.
While he acknowledged that some individuals flagged may have gained citizenship, he insisted the state is working with them to verify their status.
Allen maintained that it’s his constitutional duty to ensure that only U.S. citizens vote.
The DOJ, however, disputes the accuracy of Alabama’s data, highlighting cases where individuals flagged as noncitizens were actually born in the U.S.
Clarke emphasized the need for Alabama to avoid voter confusion and protect voter rights, especially so close to the election.
This lawsuit underscores the broader national debate over voter eligibility and election integrity.
The outcome could influence how other states handle similar efforts in the lead-up to the 2024 election.
As the case unfolds, both sides are preparing to present their arguments before a federal judge.
The DOJ is seeking an immediate halt to Alabama’s actions until the court can rule on the legality of the state’s process.

I bet there are more illegals on that list than “non-citizens”? And where does it say a state can’t do that “90 days before an election” If not now when? How rich is it that the DOJ is sueing? Where is the Justice of allowing non-citizens or illegals to vote! Our American elections are for “legal citizens” to vote only!
