A group of activist organizations is taking legal action against the federal government over executive orders issued by President Donald Trump. These orders aim to scale back diversity, equity, and inclusion programs, and also reject transgender ideology.
The lawsuit, titled National Urban League v. Trump, was filed on February 19 in the U.S. District Court for the District of Columbia, with Judge Loren AliKhan overseeing the case.
The plaintiffs include the National Urban League, National Fair Housing Alliance, and AIDS Foundation of Chicago. They argue that the executive orders violate federal law and the First and Fifth Amendments of the U.S. Constitution.
These nonprofits rely heavily on federal grants and contracts to support services for diverse communities, which they claim are threatened by the new orders.
Among the defendants are President Trump, named in his official capacity, several federal agencies, and the officials who lead them. Specific agencies involved include the Departments of Labor, Health and Human Services, and Justice, among others.
The case also targets agencies like the Environmental Protection Agency and the Centers for Disease Control and Prevention.
This legal challenge was filed by Lambda Legal and the NAACP Legal Defense and Educational Fund. Marc Morial, president of the National Urban League, expressed that the executive orders are an attack on diversity, equity, and inclusion. He described them as discriminatory and potentially oppressive.
John Peller, president of the AIDS Foundation Chicago, emphasized the importance of addressing health disparities for marginalized groups.
He stated that the executive orders could hinder critical health work and put communities at risk. Lisa Rice, president of the National Fair Housing Alliance, argued that the orders contradict constitutional and civil rights laws.
The lawsuit focuses on Executive Orders 14151, 14168, and 14173. Executive Order 14151 mandates the cessation of discriminatory programs, including DEI initiatives within the federal government. This order directly challenges previously established DEIA mandates.
Executive Order 14168 enforces the recognition of only two sexes, male and female, and dismisses the concept of a gender spectrum.
This stands in contrast to the DEIA framework introduced by President Biden, which included a broader recognition of gender identities. Trump’s order rejects this inclusive approach by negating the DEIA principles.
Executive Order 14173 targets race- and sex-based preferences disguised as DEI or DEIA initiatives. The plaintiffs argue these orders penalize them for supporting DEIA and transgender rights. They also claim the orders threaten their federal funding and restrict their freedom of expression.
The complaint suggests that these orders impose the president’s views on federal contractors and grantees. The plaintiffs assert that this violates their organizational missions and endangers the federal funding crucial for their work. They contend that the First Amendment protects them from such impositions.
The U.S. Department of Justice, representing the defendants, has been contacted for comment. However, no response was received before the article’s publication. This ongoing legal battle highlights tensions between federal policies and nonprofit advocacy efforts.
