An Ohio-based meat processing company, Fresh Mark, Inc., has reached a non-prosecution agreement (NPA) with federal authorities after being implicated in a shocking identity theft and immigration fraud scheme. The case revealed that the company’s hiring manager orchestrated a plot involving stolen U.S. citizens’ identities to illegally employ migrant workers.
The investigation, which spanned from 2013 to 2018, uncovered a conspiracy led by Fresh Mark’s hiring manager, Yelwin Omar Munoz-Solis. Federal authorities revealed that Munoz-Solis, 43, of Salem, Ohio, collaborated with others to steal identities of U.S. citizens, which were then provided to undocumented immigrants seeking jobs at Fresh Mark’s meat processing plants in Salem, Massillon, and Canton.
Using the stolen identities, Munoz-Solis falsified I-9 employment eligibility verification documents, creating the illusion of compliance with federal hiring laws. His actions not only enabled the employment of unauthorized workers but also deceived federal authorities during routine inspections.
The scheme came to light during a Homeland Security Investigations (HSI) operation in 2018. Federal agents executed search warrants at Fresh Mark’s facilities, detaining 146 undocumented workers who had gained employment through fraudulent means.
Among those detained, 30 individuals faced federal charges for immigration violations. The case reached a turning point when Munoz-Solis pleaded guilty to multiple charges, including:
- Conspiracy to commit aggravated identity theft
- Aggravated identity theft
- Making false statements on immigration documents
Fresh Mark, a nationwide producer of processed meats under the Sugardale and Superior Brand Meats labels, entered into the NPA to avoid criminal prosecution. As part of the agreement, the company has agreed to pay a $3.7 million penalty and implement rigorous compliance and ethics programs to prevent future violations.
The funds from the penalty will be allocated to the federal Crime Victims Fund under the Victims of Crime Act Fix to Sustain the Crime Victims Fund Act of 2021. Additionally, Fresh Mark will adhere to compliance reporting requirements for the next two years to ensure its hiring practices align with federal laws.
“Stealing identities to transfer to others not eligible to work is not an acceptable business practice,” stated U.S. Attorney Rebecca Lutzko for the Northern District of Ohio. “Employers must ensure that their hiring practices comply with all federal laws, and businesses caught providing false statements to the government will be held to account.”
HSI Detroit Special Agent in Charge Angie M. Salazar also commended the multi-year effort, saying, “This settlement is a testament to HSI’s commitment to the American people and our Ohio communities. I’m extremely proud of the agents and prosecutors who saw this case through until the end. We must remain vigilant and ensure that all companies abide by the law when it comes to labor practices.”

The federal authorities should notify *each* individual victim whose identity was stolen of (1) that victim’s status and need to check all credit sources, etc.; and (2) that victim’s right to sue Fresh Mark and its executives civilly for the tort inflicted on him or her. Since the government is too gutless to prosecute the other responsible individuals, a flood of personal lawsuits would be the next best thing to get the attention of industry operatives.
And what about Mr. Muniz-Solis who pleaded guilty to three Federal charges (should have been a lot more)? What is/was his sentence? Did they take away his ice cream privileges at recess; or just get him to promise he won’t do it again. By the way, did he give these fake documents to the immigrants free of charge; or did he sell the papers to those people ? I know which way I would guess.
So the underlying message from this is it’s ok to break state & federal laws as long as you have enough money to buy your way out of it when caught. This company should have been shut down PERIOD!!
Did they put them in prison and deport them. That’s all that matters 30 less illegals stealing our taxpayers money.

That’s why it’s getting worse all the time because more players (Congress, Big Corporate and Institutional Organizations) are selling out!
