Sunny Hostin, co-host of The View, has come to the defense of her husband, Dr. Emmanuel “Manny” Hostin, who is embroiled in a massive $450 million civil RICO lawsuit. The suit, filed in federal court on December 17, accuses the prominent orthopedic surgeon and nearly 200 other defendants of participating in a wide-ranging insurance fraud scheme targeting American Transit Insurance Company.
The case, one of the largest of its kind in New York, alleges that Dr. Hostin accepted illegal kickbacks for unnecessary medical procedures while fraudulently billing the insurer, which primarily serves taxi, Uber, and Lyft drivers.
Speaking to Page Six, Sunny Hostin dismissed the allegations as baseless, calling the lawsuit a “desperate” move by American Transit to dodge its financial obligations.
“This is a frantic attempt to avoid paying for legitimate medical and surgical procedures for injured people,” Sunny, 56, said. “Our family will not be intimidated or harassed. We remain unbowed.”
She accused the insurer of engaging in a “disgusting media smear campaign” aimed at tarnishing her family’s reputation, including that of her children, Gabriel, 22, and Paloma, 18.
Sunny also claimed American Transit is on the verge of bankruptcy, referencing a 2014 lawsuit filed against the company by Uber and an investigation by New York State’s Department of Financial Services.
In a defiant statement, she quipped, “Where I come from, American Transit will receive a PHD from FAFO University,” referencing the phrase “F*** around and find out.”

The lawsuit alleges that Dr. Hostin exploited New York’s No-Fault Insurance Law, which mandates coverage of up to $50,000 for medical expenses stemming from motor vehicle accidents. According to American Transit, Dr. Hostin referred patients to the Empire State Ambulatory Surgery Center in exchange for illegal kickbacks disguised as dividends or cash distributions.
The insurer cites two specific cases from January 2023 where Dr. Hostin performed arthroscopic surgeries on patients involved in minor car accidents. American Transit contends these surgeries were medically unnecessary and could have been resolved with less invasive treatments.
Attorney William Natbony, representing American Transit, emphasized the broader impact of such schemes. “No-fault fraud is a huge problem in New York. This lawsuit is part of our responsibility to combat it,” Natbony stated.
The company is seeking over $450 million in damages, claiming that systemic exploitation of the No-Fault Law has destabilized the insurance market, increased premiums for drivers, and resulted in substantial financial losses.
Dr. Hostin’s legal team has vehemently denied the allegations, calling them baseless and defamatory. Prominent attorney Mark Geragos, recently hired by the Hostins, announced plans for a $5 million countersuit unless American Transit withdraws its claims and issues a public apology.
“The lawsuit is a scattershot attempt to intimidate doctors and minimize payouts for injured patients,” said Geragos. “Dr. Hostin has an impeccable record, and this case is nothing more than a smear campaign.”
Daniel Thwaites, another attorney representing Dr. Hostin, echoed Geragos’ sentiments. He criticized American Transit for failing to address any concerns with Dr. Hostin before filing the lawsuit.
Geragos also cited a damning 83-page report from New York State’s Department of Financial Services, which details financial irregularities at American Transit. He argued that the insurer has a history of mismanaging claims and avoiding its legal responsibilities.
American Transit alleges that no-fault fraud has created a crisis in New York’s insurance market, driving up premiums for drivers while enriching unethical medical professionals and facilities. The insurer claims to have paid out hundreds of millions of dollars in fraudulent claims over the years.
Meanwhile, Sunny Hostin remains steadfast in her defense of her husband. “This is not just a legal battle; it’s an attack on our integrity and our family,” she said.
As the case moves forward in federal court in Brooklyn, both sides are digging in for a contentious legal battle. For Dr. Hostin, the stakes are high—both financially and professionally. For Sunny Hostin, the case represents a direct challenge to her family’s reputation and a test of her public resolve.
While American Transit frames the lawsuit as a necessary step to combat widespread fraud, the Hostins argue it’s a reckless attempt to deflect from the insurer’s own failings.
The outcome of this case could have far-reaching implications, not only for the Hostin family but also for the broader fight against insurance fraud in New York. As legal experts weigh in and public scrutiny intensifies, the battle lines are drawn in one of the most high-profile civil RICO cases in recent memory.
