Schumer Plans to Use Biden Judges to Block Trump and GOP Congress.

As President-elect Donald Trump prepares to return to the White House with Republican majorities in both chambers of Congress, Senate Democratic Leader Chuck Schumer (D-NY) has unveiled a strategy to obstruct the GOP’s agenda using the judiciary. Schumer, working in tandem with President Joe Biden, has spent the last four years appointing and confirming a record number of left-leaning federal judges to serve as a judicial bulwark against Republican policies.

In a recent interview with Politico, Schumer proudly detailed his efforts to pack the federal judiciary with Democratic appointees, who, he asserts, will act as a partisan check against Trump’s executive orders and the Republican-controlled Congress’s legislation.

“I don’t know exactly what [Trump will] do. But I can tell you this: The judiciary will be one of our strongest—if not our strongest—barrier against what he does,” Schumer stated.

This aggressive judicial strategy has already been set in motion. Over the past four years, Schumer and Biden successfully appointed 235 judges—more than a quarter of the federal judiciary. This unprecedented push was driven by the expectation that these judges would uphold Democratic policies and block Republican attempts to overturn them.

Schumer did not shy away from addressing the partisan nature of this judicial campaign. He candidly acknowledged that stacking the judiciary was crucial to preserving Democratic achievements in areas such as women’s rights, environmental protections, and labor rights.

“They’re going to come after everything,” Schumer said of the incoming Republican administration. “They have so many different parts of MAGA: the people who are anti-women’s rights; the people who are anti-environment; the people who are anti-working people rights and union rights; the people who are anti-the consumer. They’re going to use the judiciary in every way they can.”

Schumer’s remarks underscored the importance of countering what he described as “MAGA judges” appointed during Trump’s first term, whom he characterized as “extreme” and “out of balance” with mainstream values.

Throughout Biden’s presidency, Schumer managed to strike a delicate balance between passing major Democratic legislation and confirming a historic number of judges. As legislative gridlock increased in recent years, judicial appointments took on even greater significance.

“It became much more important, because we saw that we would not be able to accomplish more legislatively,” Schumer explained. “And we also saw that the hard right was gearing up to use the bench in case after case to achieve their goals.”

This proactive approach to judicial confirmations, Schumer believes, will provide Democrats with a vital counterweight to Republican efforts to use the courts to advance their agenda.

President Biden has also celebrated the record number of judicial appointments as a defining aspect of his presidency. In a statement marking the milestone, Biden emphasized not only the qualifications of the appointees but also their demographic diversity and range of experiences.

“Judges matter,” Biden stated. “They shape the everyday lives of Americans, preserving our freedoms and defending our liberties. Biden added, “I am proud of the legacy I will leave with our Nation’s judges. And I am proud of those who have stepped forward and heeded the call to serve.”

Republicans, however, are not taking this judicial strategy lightly. Many in the GOP have criticized Schumer and Biden’s judicial appointments as an overt attempt to politicize the judiciary and undermine the balance of power between the executive, legislative, and judicial branches.

As Trump prepares to re-enter the White House, the Republican-controlled Congress is expected to challenge Democratic policies on multiple fronts, from reversing Biden-era environmental regulations to rolling back labor protections and social programs.
