He notes that Letitia James’s Power of Attorney document may have been a deceptive attempt to gain favorable financing on the Virginia property—one that, if proven false, would expose her to potential federal wire fraud charges under 18 U.S. Code § 1343. Wire fraud is a felony, punishable by up to 20 years in federal prison. It’s the same charge used to take down countless other high-profile white-collar criminals.

Furthermore, if James falsely claimed Virginia residency to lenders while maintaining her role as a New York official, she may have committed perjury or falsified documents—both prosecutable offenses under state and federal law.
