Alvin Bragg’s office has agreed to postpone Trump’s sentencing, originally scheduled for July 11, following the Supreme Court’s decision on presidential immunity.
In a 6-3 ruling on Monday, the Supreme Court determined that Trump has absolute immunity for his fundamental Constitutional powers.
“Although we believe defendant’s arguments to be without merit, we do not oppose his request for leave to file and his putative request to adjourn sentencing pending determination of his motion,” assistant district attorney Josh Steinglass wrote in a letter to Judge Juan Merchan, ABC News reported.
President Trump attempted to overturn his ‘hush money’ conviction on Monday following a Supreme Court ruling granting him presidential immunity for official acts.
His legal team had previously used the presidential immunity argument to delay the trial, but it was unsuccessful.
In May, President Trump was found guilty of all 34 felony counts in Manhattan DA Alvin Bragg’s ‘hush money’ trial.
The judge informed the jurors that they did not need to agree on a specific crime, which is unprecedented in US history and deemed unconstitutional by President Trump’s lawyers.
They argued that part of the case against Trump relied on his time in the White House, and the Supreme Court’s immunity ruling prohibits prosecutors from using that evidence.
“Although the Manhattan case does not center on Mr. Trump’s presidency or official acts — but rather personal activity during his campaign — his lawyers argued on Monday that prosecutors had built their case partly on evidence from his time in the White House. And under the Supreme Court’s new ruling, prosecutors not only cannot charge a president for any official acts, but also cannot cite evidence involving official acts to bolster other accusations.” – The New York Times reported.
The sentencing is expected to be postponed for a few weeks as Judge Merchan has not made a decision on Trump’s motion yet.
